Everything IOLTA: Rules, Regulations & Record-keeping

Presenter:  Lainie Hammond, IOLTA Trust Account Compliance Attorney


Lainie Hammond returns to give us an overview of the IOLTA Rules under the RPCs, what is required and prohibited, and a discussion of practice area specific concerns related to IOLTAs, and helpful hints for preventing and detecting fraud against IOLTAs.  Ms. Hammond will take a detailed look at setting up an IOLTA, maintain the proper records required under the RPCs, closing IOLTAs, and the daily, monthly and annual reporting requirements, as well as discussing recent ethics opinions related to IOLTA accounts.  She will take questions at the end.

Materials will be distributed electronically to registered attendees prior to CLE - please print and bring them  if you wish to have them for the CLE.

This CLE is free.  SCBA members will receive 1.0 WSBA Ethics Credit.

Non-members are welcome to attend but will not receive credit.

Lainie Hammond worked as the Washington State Bar Association IOLTA random auditor before opening her own practice assisting attorneys with IOLTA compliance issues.  She helps lawyers meet their obligations under RPC 1.15A and 1.15B, as well as representing attorneys facing grievances and trust account overdrafts.  In addition to Random Auditor, Lainie was the WSBA Custodianship Counsel, taking over a lawyer’s files in cases of disbarment, death, or disappearance.  She assisted in staffing the Ethics Hotline, worked as an Advisor in the Law Office Management Assistance Program, and as staff liaison to the Young Lawyer’s Committee.  Before working at WSBA, Lainie was a federal investigator for the US Dept. of Labor enforcing ERISA compliance, and consulted overseas on issues related to conflicts of interest and fraud detection in pension and health care plans.
